Terms of Service

Welcome to VESPER (“App”). These Terms of Service (“ToS”) govern your use of the App. By accessing or using the App, you agree to be bound by these terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these terms. The App is intended for personal, non-commercial use by cost-conscious Las Vegas travelers.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal use, subject to these ToS. You may not modify, reverse-engineer, or distribute the App.

3. User Responsibilities

You agree to:

  • Provide accurate information when registering or entering transactions.
  • Use the App lawfully and in accordance with these ToS.
  • Not use the App to engage in illegal activities, including unlawful gambling.
  • Not share your account credentials or allow unauthorized access.

4. Community Notes and Trip Agendas

  • Community Notes: You may submit notes to be shared as community notes, visible to other users, only with your explicit consent. You retain ownership of your notes but grant us a non-exclusive, worldwide, royalty-free license to display and distribute them as anonymized community notes.
  • Trip Agendas: In future releases, you may share trip agendas with explicit consent, subject to the same licensing terms as community notes.
  • Content Restrictions: You agree not to submit content that is unlawful, defamatory, obscene, or infringes on third-party rights.

5. AI Insights

In future releases, we may use anonymized user data to generate AI-driven insights and recommendations. By using the App, you consent to the use of your anonymized data for this purpose, unless you opt out via the App’s settings.

6. Intellectual Property

The App, including its design, code, and content (excluding user-generated content), is owned by us or our licensors. You may not copy, reproduce, or distribute any part of the App without permission.

7. Termination

We may suspend or terminate your access to the App if you violate these ToS, engage in unlawful activity, or at our discretion. Upon termination, your license to use the App ends, but certain provisions (e.g., intellectual property, liability) survive.

8. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App. The App is provided “as is” without warranties of any kind.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your use of the App or violation of these ToS.

10. Governing Law

These ToS are governed by the laws of [insert state, e.g., Nevada], without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts of [insert jurisdiction].

11. Changes to These Terms
